These Terms & Conditions (“Terms”, “Terms & Conditions”) govern access to and use of the Ambassador Boutique website and the purchase of products through the website.

The website is operated by:

LEOPOLDS SARL-S

Grand Duchy of Luxembourg

hereinafter referred to as “Ambassador Boutique”, “we”, “us” or “our”.

RCS: [RCS NUMBER]
VAT: [VAT NUMBER]
Business Licence: [BUSINESS LICENCE NUMBER, IF APPLICABLE]
Customer Service: [CUSTOMER SERVICE EMAIL]

By using the website or placing an order, you acknowledge that you have read and understood these Terms & Conditions.

Nothing in these Terms limits or excludes mandatory consumer rights applicable under Luxembourg, European Union or other applicable law.

PART I – TERMS OF USE

1. WEBSITE USE

You may use this website only for lawful purposes and in accordance with these Terms.

You must not:

  • use the website for unlawful purposes;
  • attempt to interfere with its operation or security;
  • introduce malicious software;
  • attempt to gain unauthorised access;
  • scrape or systematically copy website content without permission;
  • impersonate another person or entity;
  • use the website to submit fraudulent information;
  • or otherwise misuse the website.

We reserve the right to restrict or terminate access where reasonably necessary to protect the website, our business, other customers or third parties, subject to applicable law.

2. WEBSITE CONTENT

We make reasonable efforts to ensure that information displayed on the website is accurate and current.

However, product images, colours, dimensions, descriptions and other visual representations may vary slightly from the physical product.

Minor differences that do not affect the essential characteristics or conformity of the product do not necessarily constitute a defect.

We may correct typographical, pricing, availability or other errors at any time, subject to applicable law.

3. PRODUCTS

Ambassador Boutique primarily sells and distributes products for dogs and cats, including accessories and other pet-related products.

From time to time, other categories of products may also be offered.

Ambassador Boutique is generally a retailer and distributor and does not manufacture products merely because it sells or distributes them.

Products may therefore be subject to manufacturer instructions, warnings, limitations and commercial warranties.

4. PRODUCT SAFETY

Products must be used in accordance with their intended purpose, instructions and safety warnings.

Customers must read applicable product instructions before use.

For pet products, customers remain responsible for appropriate supervision of the animal, particularly where the nature of the product requires supervision.

Where we become aware that a product may be unsafe or non-compliant, we may suspend sales, contact affected customers and take other measures required by applicable product-safety law.

PART II – TERMS OF SALE

5. SCOPE

These Terms apply to orders placed through Ambassador Boutique.

Before completing an order, customers will be provided with the applicable essential information concerning the products, price, delivery charges and other mandatory information.

6. ELIGIBILITY

By placing an order, you confirm that:

  • you have legal capacity to enter into the purchase contract; and
  • the information you provide is accurate and complete.

If you are purchasing on behalf of a business, you confirm that you are authorised to act for that business.

Consumer protections that apply by law remain unaffected.

7. PRODUCT AVAILABILITY

All products are subject to availability.

Displaying a product on the website does not guarantee that the product will remain available until checkout or dispatch.

If an ordered product becomes unavailable, we may contact you regarding the available options or refund the unavailable item.

8. PRODUCT INFORMATION

We aim to provide accurate product descriptions, photographs, specifications and safety information.

However, manufacturer packaging, labelling or product appearance may change.

Where a mandatory product warning or instruction applies, the customer must follow it.

9. ORDERS

An order is placed when the customer completes the checkout process and submits the order.

The order acknowledgement confirms receipt of the order but does not necessarily mean that the order has been dispatched.

A binding sales contract is formed in accordance with the order process and applicable law.

We may refuse or cancel an order where reasonably justified, including where:

  • the product is unavailable;
  • there is an obvious pricing or description error;
  • payment cannot be authorised;
  • fraud or misuse is reasonably suspected;
  • the delivery address is invalid or unsupported;
  • legal or product-safety requirements prevent fulfilment; or
  • circumstances beyond our reasonable control prevent fulfilment.

Where payment has already been received for an order that we cancel, the corresponding amount will be refunded.

10. ORDER CONFIRMATION

Following submission of an order, we may send an electronic order confirmation containing relevant order information.

Customers should verify the confirmation and notify us promptly of any apparent error.

11. CANCELLATION BEFORE DISPATCH

Where an order has not yet been dispatched, customers may contact us to request cancellation.

We will make reasonable efforts to accommodate cancellation requests.

However, once an order has entered fulfilment or has been handed to the carrier, cancellation may no longer be operationally possible.

In such circumstances, the customer may still exercise any applicable statutory right of withdrawal after delivery.

12. PRICES

Prices displayed on the website are shown in euros unless otherwise indicated.

For consumer purchases, applicable VAT is included or separately identified as required by law.

The applicable VAT treatment may depend on the customer’s destination and the applicable tax rules.

Shipping charges, where applicable, are displayed during checkout before the customer submits the order.

13. TAXES AND INTERNATIONAL ORDERS

Ambassador Boutique currently serves customers within the European Union and may also serve the United Kingdom, Switzerland, Iceland and Norway, subject to availability and applicable restrictions.

Depending on the destination and fulfilment structure, the customer may be responsible for import VAT, customs duties, customs clearance charges or other amounts imposed by the destination country.

Where applicable taxes and duties are collected at checkout, this will be indicated during the ordering process.

Customers should consult the Shipping Policy for further information.

14. PAYMENT

Available payment methods are displayed during checkout.

The payment provider may apply its own terms and security procedures.

We do not normally dispatch orders until payment has been successfully authorised or otherwise secured.

If payment fails, we may cancel the order if payment cannot be completed within a reasonable period.

15. RETENTION OF TITLE

Where permitted by applicable law, products remain the property of Ambassador Boutique until the purchase price and any applicable amounts have been paid in full.

This clause does not affect statutory consumer rights.

16. DELIVERY

Delivery is governed by our Shipping Policy, which forms part of these Terms.

Delivery estimates displayed at checkout are estimates unless expressly stated otherwise.

Where no specific delivery period has been agreed, applicable consumer law generally requires delivery within the statutory period.

For EU consumer transactions, where no different delivery period has been agreed, the applicable default period is generally 30 days.

17. DELIVERY ADDRESSES

Customers are responsible for providing a complete and accurate delivery address.

Customers should promptly notify us of any address error.

If an incorrect address supplied by the customer causes additional delivery or return costs, we may seek reimbursement of reasonable costs where permitted by law.

18. DELIVERY ATTEMPTS AND UNCLAIMED PARCELS

Customers should ensure that someone is reasonably available to receive the parcel where required.

If a parcel cannot be delivered because of an inaccurate address, refusal, failure to collect or another circumstance attributable to the customer, the carrier may return the parcel to us.

Any consequences and costs will be handled in accordance with applicable law and the Shipping Policy.

19. RISK

For consumer sales, the risk of loss or damage generally passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.

Nothing in these Terms transfers risk earlier where mandatory law provides otherwise.

20. RIGHT OF WITHDRAWAL

Where applicable, consumers have a statutory right to withdraw from a distance contract within 14 calendar days, without providing a reason.

For goods, the period generally begins when the consumer or a designated third party acquires physical possession.

The customer must communicate the withdrawal within the applicable statutory period.

The Returns & Refunds Policy provides the operational procedure.

21. WITHDRAWAL EXCEPTIONS

The statutory right of withdrawal does not apply in circumstances established by applicable law.

Depending on the product and circumstances, this may include:

  • personalised goods;
  • goods made to the consumer’s specifications;
  • rapidly deteriorating or expiring goods;
  • sealed goods that are unsuitable for return for health or hygiene reasons once unsealed;
  • certain sealed software, audio or video products once unsealed;
  • certain digital content once performance has begun with the required consent and acknowledgement;
  • goods that become inseparably mixed with other goods;
  • and other statutory exceptions.

22. CUSTOMER’S OBLIGATION TO TAKE CARE OF PRODUCTS

During the withdrawal period, customers must handle products only to the extent necessary to establish their nature, characteristics and functioning.

Customers may be responsible for diminished value caused by handling beyond what is reasonably necessary, where permitted by applicable law.

23. RETURNS AND REFUNDS

Returns and refunds are governed by the Returns & Refunds Policy.

Depending on the circumstances, a customer may be entitled to:

  • a refund;
  • repair;
  • replacement;
  • price reduction;
  • contract termination;
  • or another statutory or contractual remedy.

A return request does not automatically mean that a full refund is due.

24. DEFECTIVE OR NON-CONFORMING PRODUCTS

Customers benefit from applicable statutory legal guarantee rights.

For consumer goods within the EU, the statutory legal guarantee is generally at least two years.

Depending on the circumstances and applicable law, the consumer may be entitled to repair, replacement, price reduction or refund/termination.

Ambassador Boutique may first seek to provide repair or replacement where legally appropriate.

Nothing in these Terms requires a customer to rely exclusively on a manufacturer’s warranty instead of mandatory rights against the seller.

25. 24-HOUR DELIVERY INSPECTION

Customers are strongly required to inspect deliveries promptly.

Customers should notify Ambassador Boutique, preferably within 24 hours of delivery, of:

  • visible parcel damage;
  • visible product damage;
  • incorrect products;
  • missing products;
  • immediately apparent defects; or
  • other issues identifiable upon initial inspection.

Customers should preserve the packaging and provide photographs where possible.

The 24-hour notification period is an operational and evidentiary requirement intended to facilitate investigation of transport and fulfilment issues.

It does not reduce, waive or extinguish mandatory statutory rights, including the statutory right of withdrawal or applicable legal guarantee rights.

26. MANUFACTURER WARRANTIES

Some products may benefit from additional manufacturer’s or commercial warranties.

Such warranties may provide additional rights but do not replace mandatory statutory rights against Ambassador Boutique.

27. PRODUCT SAFETY, RECALLS AND COOPERATION

Where a product is subject to a safety warning, recall or corrective measure, customers must follow the instructions communicated by Ambassador Boutique, the manufacturer or competent authority.

Customers should cooperate with reasonable recall, withdrawal or safety procedures.

28. USER ACCOUNTS

Customers may be able to create accounts on the website.

Customers are responsible for keeping account credentials confidential and for activity carried out through their account, except where unauthorised use results from circumstances for which the customer is not responsible.

We may suspend or terminate accounts where reasonably necessary to prevent fraud, misuse or security risks, subject to applicable law.

29. REVIEWS AND USER CONTENT

Where the website permits reviews or other user content, customers must ensure that submissions are truthful and lawful.

Customers must not submit:

  • fraudulent reviews;
  • defamatory content;
  • unlawful material;
  • malware;
  • personal information belonging to others without lawful basis;
  • or content infringing third-party rights.

We may moderate or remove content where legally justified.

30. INTELLECTUAL PROPERTY

Website content, including text, graphics, logos, photographs, designs and software, is owned by or licensed to Ambassador Boutique or its respective rights holders.

You may not reproduce, distribute, modify or commercially exploit website content without permission, except where permitted by law.

31. TRADEMARKS

Ambassador Boutique and related names, logos and branding may constitute trademarks or protected business identifiers.

Unauthorised use is prohibited to the extent protected by applicable law.

32. THIRD-PARTY WEBSITES AND SERVICES

The website may contain links or integrations involving third-party services.

Ambassador Boutique is not responsible for the content, availability or policies of third-party websites except where required by law.

33. LIABILITY

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Subject to mandatory law, Ambassador Boutique is not responsible for indirect losses that could not reasonably have been foreseen at the time the contract was concluded.

Nothing limits liability for matters that cannot legally be limited or excluded, including mandatory consumer rights.

34. FORCE MAJEURE

We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including:

  • natural disasters;
  • war;
  • civil disturbance;
  • strikes;
  • major transport disruption;
  • carrier failures;
  • cyber incidents;
  • government restrictions;
  • customs delays;
  • epidemics or pandemics;
  • or other comparable circumstances.

This does not remove mandatory consumer rights concerning cancellation or refunds where applicable.

35. COMPLAINTS

Customers should first contact Ambassador Boutique so that we can attempt to resolve complaints efficiently.

Complaints should include the order number and sufficient information to identify the issue.

36. DISPUTE RESOLUTION

We encourage customers to contact us first to seek an amicable resolution.

The European Online Dispute Resolution platform previously operated under Regulation (EU) No 524/2013 has been discontinued and should not be used as a current contact mechanism.

Consumers retain any applicable rights to use competent courts, recognised alternative dispute-resolution mechanisms or other remedies available under applicable law.

37. GOVERNING LAW

These Terms are governed by applicable Luxembourg law, subject to mandatory consumer protection provisions applicable in the consumer’s country of residence.

A consumer cannot be deprived of mandatory protections that apply to the transaction.

38. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The version applicable to an order will generally be the version in force when the order was placed, subject to mandatory law.

39. SEVERABILITY

If any provision is found invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

40. NO WAIVER

Failure to enforce a provision immediately does not constitute a permanent waiver of that provision.

41. LANGUAGE

These Terms are drafted in English.

Where legally required, mandatory information may also be made available in other languages.

42. ORDER OF PRECEDENCE

The following documents form part of the contractual framework governing purchases:

  1. these Terms & Conditions;
  2. the applicable product information;
  3. the Shipping Policy;
  4. the Returns & Refunds Policy;
  5. the Privacy Policy and Cookie Policy, where relevant to their respective subject matter.

If there is a conflict between these documents and mandatory law, mandatory law prevails.

4. Trademarks and Brand Identity

You may not use our trademarks, logos, trade names or other brand elements in a manner that may cause confusion, imply an affiliation or endorsement, or otherwise infringe our rights.

Third-party trademarks appearing on the Website remain the property of their respective owners.

5. Account Registration

Certain features of the Website may require you to create an account.

When creating or using an account, you agree to provide accurate, current and complete information.

You are responsible for maintaining the confidentiality of your login credentials and for taking reasonable steps to prevent unauthorised access to your account.

  • your account has been accessed without authorisation;
  • your password has been compromised; or
  • information associated with your account is inaccurate or requires updating.

You are responsible for activities carried out through your account to the extent permitted by applicable law.

Where appropriate and legally permitted, we will inform you of the reason for such action.

Closing an account does not affect rights or obligations arising from orders already placed or transactions already completed.

6. Reviews, Comments and User Content

You must not submit content that:

  • is unlawful, fraudulent or misleading;
  • is defamatory, threatening, abusive, discriminatory or hateful;
  • infringes copyright, trademarks, privacy rights or other third-party rights;
  • contains malicious software;

  • constitutes spam or unauthorised advertising;
  • impersonates another person or business; or
  • otherwise violates applicable law.

You represent that you have the necessary rights to submit the User Content.

By submitting User Content, you grant Ambassador Boutique a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and publish that content for the purposes of operating, promoting and improving the Website and our services, subject to applicable law.

Where technically and legally appropriate, we may identify the contributor by the name or username associated with the submission.

We reserve the right to remove or refuse User Content that we reasonably consider unlawful, inappropriate, misleading or inconsistent with these Terms.

This does not create an obligation for Ambassador Boutique to monitor all User Content.

7. Intellectual Property Complaints

If you believe that content available on the Website infringes your copyright, trademark, design right or another intellectual property right, please contact us with sufficient information to identify:

  • the protected work or right concerned;
  • the allegedly infringing material;
  • the location of that material on the Website;
  • your contact details; and
  • any information reasonably necessary for us to assess your complaint.

We may remove or restrict access to content where appropriate and in accordance with applicable law.

8. Third-Party Websites and Services

The Website may contain links to third-party websites, applications, services or resources.

Such links are provided for convenience only.

Ambassador Boutique does not control third-party websites and is not responsible for their content, availability, security, privacy practices or terms.

Your use of third-party websites and services is subject to the terms and policies of those third parties.

PART II — TERMS OF SALE

9. Scope of Sale

These Terms apply to purchases of products made through the Ambassador Boutique Website.

Ambassador Boutique sells and distributes products primarily intended for pets, including products and accessories for dogs and cats, together with other products that may be offered through the Website from time to time.

The specific characteristics, intended use, materials, dimensions, warnings and other relevant information applicable to a product are provided on the relevant product page where applicable.

We do not manufacture products merely because we sell or distribute them.

Where required by applicable product-safety legislation, information concerning the manufacturer, importer, responsible person, safety warnings or other regulatory information will be made available with the product or on the Website.

10. Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, prices and other information displayed on the Website are accurate and up to date.

However:

  • colours may appear differently depending on your screen;
  • packaging or labelling may change;
  • manufacturers may make minor changes to products;
  • product availability may change; and
  • minor typographical or technical errors may occasionally occur.

Such minor differences do not affect your statutory rights.

Where a product is subject to specific safety instructions or restrictions, you are responsible for reading and following those instructions.

11. Product Availability

All products are subject to availability.

A product displayed on the Website is not necessarily guaranteed to remain available until an order is placed.

If a product becomes unavailable after you place an order, we will inform you as soon as reasonably possible.

Where we cannot fulfil an order for an unavailable product, we will provide an appropriate refund for amounts paid for that product.

Your statutory rights remain unaffected.

12. Placing an Order

When you place an order through the Website, you are making an offer to purchase the products selected by you.

Before submitting your order, you will have the opportunity to review:

  • the products selected;
  • quantities;
  • prices;
  • applicable taxes;
  • shipping charges;
  • delivery information; and
  • the total amount payable.

You should check all information carefully before submitting your order.

After receiving your order, we will normally send an electronic acknowledgement confirming that your order has been received.

This acknowledgement does not necessarily mean that your order has been accepted.

Unless otherwise stated at checkout, the sales contract is concluded when we confirm that the order has been accepted and/or the products have been dispatched.

If we are unable to accept your order, we will inform you and refund any amount already paid for the affected order or product.

13. Order Cancellation Before Dispatch

Where permitted by applicable law, you may request cancellation of an order before the products have been dispatched.

Once an order has been dispatched, the statutory right of withdrawal and our applicable returns procedures will apply.

Certain products may be subject to statutory exceptions to the right of withdrawal.

14. Prices and VAT

All prices displayed on the Website are stated in EUR (€) unless expressly indicated otherwise.

For consumer purchases within the European Union, prices displayed to consumers will include applicable VAT where required by law.

The applicable VAT rate may depend on the destination country and the nature of the product.

For reference, standard VAT rates applicable to many ordinary goods currently include:

Territory Standard VAT rate*
Luxembourg 17%
European Union Destination country’s applicable VAT rate
United Kingdom 20%
Switzerland 8.1%
Norway 25%

* These are reference standard rates and are not a guarantee that every product is subject to that rate. Reduced rates, exemptions, special schemes or product-specific rules may apply.

Where Ambassador Boutique is required to collect VAT at checkout, the applicable amount will be shown in the order summary in EUR.

For cross-border orders outside the EU, including the United Kingdom, Switzerland, Norway and, where available, Iceland, additional import VAT, customs duties or customs clearance charges may apply unless the checkout expressly states that applicable taxes and duties are included.

Further information is provided in our Shipping Policy.

15. Pricing Errors

We take reasonable care to ensure that prices displayed on the Website are accurate.

If we discover a material pricing error before dispatch, we may contact you and give you the option to:

  • proceed with the order at the correct price; or
  • cancel the affected order or product and receive a refund.

If we have already accepted and dispatched the order, mandatory consumer rights will apply.

Nothing in this section limits rights you may have under applicable law.

16. Payment

Payment methods available to you will be displayed during checkout.

Depending on the payment method selected, payment may be processed by an independent payment service provider.

You authorise the applicable payment provider to process the payment required for your order.

We may refuse or cancel an order where:

  • payment is not successfully authorised;
  • there is a reasonable suspicion of fraud or unauthorised activity;
  • required information is incomplete or materially inaccurate; or
  • we are legally prohibited from completing the transaction.

Any payment-related personal data is processed in accordance with our Privacy Policy and, where applicable, the privacy policy of the relevant payment provider.

17. Retention of Title

To the extent permitted by applicable Luxembourg law, products remain the property of Ambassador Boutique until the purchase price has been paid in full.

This provision does not affect the transfer of risk or any mandatory rights applicable to consumers.

18. Delivery

Delivery is made to the address provided during checkout.

Available delivery methods, estimated delivery times and applicable shipping charges are displayed during the ordering process or in our Shipping Policy.

Estimated delivery dates are not guaranteed unless a specific guaranteed delivery service has been expressly offered and confirmed.

We will make reasonable efforts to deliver orders within the indicated timeframe.

For EU consumer purchases, where no other delivery period has been agreed, mandatory statutory delivery rules apply, including the applicable maximum delivery period provided by law.

If a product becomes unavailable or a significant delivery delay occurs, we will inform you as required by law.

You remain responsible for providing a complete and accurate delivery address.

19. International Deliveries, Customs and Import Charges

Ambassador Boutique may deliver to selected destinations within the European Union, the United Kingdom, Switzerland, Norway and other countries shown as available at checkout.

For deliveries outside the EU, customs procedures may apply.

Depending on the destination and the applicable tax arrangement, you may be responsible for:

  • import VAT;
  • customs duties;
  • customs clearance charges;
  • carrier handling or brokerage charges; and
  • other legally applicable import costs.

Where such amounts are not included in the amount shown at checkout, they are payable by the recipient or importer as required by the destination country’s laws.

Customs authorities may inspect shipments in accordance with applicable law.

Customers are responsible for complying with mandatory import requirements applicable in their country, to the extent legally applicable to them.

For further information, please consult our Shipping Policy.

20. Right of Withdrawal

If you are a consumer located in the European Union or another jurisdiction where a statutory withdrawal right applies, you generally have the right to withdraw from a distance contract within 14 days without giving a reason, subject to applicable statutory exceptions.

For goods, the withdrawal period normally begins on the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods.

You may exercise the right of withdrawal by sending us a clear statement informing us of your decision to withdraw.

You may also use any withdrawal form made available by Ambassador Boutique.

To meet the deadline, it is sufficient to send your withdrawal communication before the applicable withdrawal period expires.

21. Effects of Withdrawal

If you validly exercise your statutory right of withdrawal, we will reimburse payments received from you for the relevant goods, including the cost of standard delivery where required by applicable law.

We are not required to reimburse additional costs resulting from your choice of a delivery method more expensive than the least expensive standard delivery offered by us.

Unless otherwise required by law, reimbursement may be withheld until we receive the returned goods or you provide evidence that you have sent them back, whichever occurs first.

You must return the goods without undue delay and, in any event, within the applicable statutory return period.

Unless the return is free under our policy or the law requires otherwise, you may be responsible for the direct cost of returning the goods.

You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

22. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply, or may cease to apply, in circumstances established by applicable law.

Depending on the product concerned, exceptions may include, among others:

  • goods made according to the consumer’s specifications or clearly personalised;
  • goods liable to deteriorate or expire rapidly;
  • sealed goods that are not suitable for return for reasons of health protection or hygiene and have been unsealed after delivery;
  • goods which, after delivery, become inseparably mixed with other items;
  • sealed audio or video recordings or sealed software that have been unsealed after delivery; and
  • other categories expressly excluded by applicable law.

Any applicable exception will be interpreted in accordance with the mandatory law applicable to the relevant transaction.

23. Returns and Refunds

Additional information concerning the practical return procedure, return address, return costs and refund process is provided in our Returns & Refunds Policy.

Our voluntary return arrangements, if any, are additional to and do not replace statutory consumer rights.

Where a product is defective, damaged, incorrectly supplied or does not conform to the contract, please contact us promptly so that we can assist you.

24. Legal Guarantee of Conformity

If you are a consumer in the European Union, you benefit from the mandatory legal guarantee of conformity applicable to consumer goods.

Under Luxembourg law, consumer goods are generally covered by a two-year legal guarantee of conformity.

Where a product does not conform to the contract, you may have rights including, depending on the circumstances and applicable law:

  • repair;
  • replacement;
  • an appropriate reduction of the purchase price; or
  • termination of the contract and reimbursement.

The order and availability of these remedies depend on the circumstances and applicable law.

Nothing in these Terms excludes or limits mandatory statutory guarantees.

Any voluntary manufacturer’s warranty or commercial guarantee is separate from and does not replace your statutory rights.

25. Products with Digital Elements

Where a product supplied by Ambassador Boutique contains digital elements or requires software for its intended operation, applicable statutory rules concerning digital content, updates and conformity may apply.

Where updates are legally required to maintain conformity or safety, we will provide or facilitate such updates as required by applicable law.

Customers should install relevant updates within a reasonable period where installation by the customer is required.

Nothing in this section limits mandatory statutory rights.

26. Product Safety

Ambassador Boutique is committed to offering products that comply with applicable product safety requirements.

Customers must use products in accordance with:

  • the product instructions;
  • safety warnings;
  • age restrictions, where applicable;
  • intended-use instructions; and
  • other information supplied with the product.

Where a product is subject to a safety recall or corrective action, we may contact affected customers where appropriate and take the measures required by applicable law.

If you believe that a product purchased from us presents a safety risk, please contact us promptly.

27. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing excludes or limits liability for:

  • death or personal injury caused by negligence where such liability cannot legally be excluded;
  • fraud or fraudulent misrepresentation;
  • defective products where mandatory product liability rules apply;
  • intentional misconduct or gross negligence where liability cannot legally be excluded; or
  • any other liability that cannot legally be excluded or limited.

Subject to the foregoing, Ambassador Boutique shall only be liable to the extent provided by applicable law.

We are not responsible for losses that are not reasonably foreseeable or that are caused exclusively by circumstances outside our reasonable control, subject always to mandatory consumer rights.

Nothing in these Terms affects your statutory rights as a consumer.

28. Events Outside Our Reasonable Control

We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including, where applicable:

  • natural disasters;
  • severe weather;
  • strikes or labour disputes;
  • transport disruptions;
  • customs delays;
  • governmental measures;
  • war or civil unrest;
  • major infrastructure failures;
  • cyber incidents affecting third-party infrastructure; or
  • other events that could not reasonably have been prevented.

Where such an event affects an order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.

This section does not limit mandatory rights to cancel an order or obtain a refund where applicable.

29. Applicable Law and Consumer Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of the Grand Duchy of Luxembourg, without prejudice to mandatory consumer protection provisions that apply in your country of habitual residence.

If you are a consumer residing in another EU Member State, the choice of Luxembourg law does not deprive you of protection provided by mandatory provisions of the law of your country of residence where such protection applies.

Any dispute shall be subject to the jurisdiction of the competent courts determined under applicable law.

Nothing in these Terms prevents a consumer from bringing proceedings before a court that has mandatory jurisdiction under applicable consumer protection rules.

30. Alternative Dispute Resolution

Ambassador Boutique aims to resolve customer complaints directly and efficiently.

If you have a complaint or concern, please contact our customer service first so that we can attempt to resolve the matter amicably.

Any applicable statutory rights concerning alternative dispute resolution, mediation or other consumer redress mechanisms remain unaffected.

Please note that the former European Union Online Dispute Resolution (ODR) platform has been discontinued and should not be relied upon as a current complaint channel.

31. Changes to These Terms

We may update these Terms from time to time, including where necessary to:

  • comply with changes in applicable law;
  • reflect changes to our products or services;
  • improve the operation or security of the Website;
  • introduce new Website features; or
  • correct errors or clarify existing provisions.

The version applicable to an order is the version in force when the order is placed, unless applicable law requires otherwise.

Material changes affecting consumers will be communicated or presented in an appropriate manner where required by law.

32. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it lawful and enforceable where legally possible.

The invalidity or unenforceability of one provision does not affect the validity of the remaining provisions.

33. No Waiver

If we do not immediately enforce a right or provision under these Terms, this does not constitute a waiver of that right or provision.

A waiver is effective only where expressly made and to the extent permitted by law.

34. Age and Purchases by Minors

The Website is intended primarily for adult customers.

Where applicable law requires a minimum age for entering into a binding purchase contract, the relevant age requirement applies.

Products intended for pets or other users are not necessarily intended to be purchased or used by children.

Where a minor uses the Website, they should do so with the involvement and supervision of a parent or legal guardian where required by law.

35. Language

These Terms are published in English.

Where Ambassador Boutique makes these Terms available in another language, the translated version is intended to facilitate understanding.

In the event of an inconsistency between language versions, the version that is legally controlling under applicable law shall prevail.

36. Relationship with Other Policies

These Terms should be read together with the other policies published on the Website, including:

  • Privacy Policy;
  • Shipping Policy;
  • Returns & Refunds Policy; and
  • Cookie Policy, where applicable.

Where a specific policy contains detailed operational information for a particular subject, that policy applies to that subject, provided that it does not override mandatory legal rights or these Terms.

26. LEGAL GUARANTEE OF CONFORMITY

All consumer purchases of goods are covered by the applicable statutory guarantee of conformity.

Under Luxembourg law, consumer goods are generally covered by a two-year legal guarantee of conformity from delivery.

This statutory guarantee applies independently of any voluntary commercial warranty that Ambassador Boutique or a manufacturer may offer.

Where a lack of conformity exists, the consumer may have the right, depending on the circumstances and applicable law, to request:

  • repair;
  • replacement;
  • an appropriate reduction in price; or
  • termination of the contract and reimbursement,

subject to the conditions and limitations provided by applicable law.

Repair or replacement must be provided without charge to the consumer where required by law.

A remedy may be refused where it is legally impossible or would impose disproportionate costs on the seller, subject to the applicable legal rules.

Under Luxembourg law, where a lack of conformity becomes apparent within the first 12 months following delivery, the applicable statutory presumption concerning the existence of the defect at delivery applies. After that period, the allocation of the burden of proof is governed by applicable law.

Nothing in these Terms limits or excludes the statutory guarantee of conformity.

27. HOW TO REPORT A DEFECT OR LACK OF CONFORMITY

If you believe that a product is defective or does not conform to the contract, please contact:

[CUSTOMER SERVICE EMAIL]

Please provide:

  • your order number;
  • the product name;
  • a description of the problem;
  • photographs or video where useful;
  • the date of delivery; and
  • any other information reasonably necessary to assess the claim.

We may request that the product be returned for inspection where appropriate.

Where a statutory guarantee claim is accepted, the applicable remedy will be provided in accordance with the applicable consumer legislation.

Consumers will not be required to bear costs that the applicable legal guarantee requires the seller to bear.

28. COMMERCIAL WARRANTIES

A manufacturer or Ambassador Boutique may occasionally provide a commercial warranty in addition to the statutory guarantee of conformity.

A commercial warranty is voluntary and does not replace or reduce the consumer’s statutory rights.

Where a commercial warranty is offered, its duration, scope, geographical coverage and conditions will be communicated in accordance with applicable law.

In particular, a commercial warranty cannot be used to deprive consumers of their statutory legal guarantee rights.

29. OWNERSHIP OF GOODS

Where permitted by applicable law, ownership of the products passes to the customer upon full payment of the purchase price and delivery of the goods.

Nothing in this provision affects the customer’s statutory rights.

30. CUSTOMER ACCOUNTS

The Website may allow customers to create and maintain a customer account.

When creating an account, you must provide accurate and up-to-date information.

You are responsible for maintaining the confidentiality of your login credentials and for notifying us if you suspect unauthorised access to your account.

The customer account may allow you to access information such as:

  • order history;
  • delivery information;
  • account details; and
  • other features made available by Ambassador Boutique.

We may suspend or terminate an account where reasonably necessary for security, fraud prevention, legal compliance or serious breach of these Terms.

Account closure does not affect orders already placed or statutory rights arising from previous purchases.

31. CUSTOMER RESPONSIBILITIES

When using the Website, you agree not to:

  • use the Website for unlawful purposes;
  • attempt to gain unauthorised access to the Website or another person’s account;
  • interfere with the security or operation of the Website;
  • introduce malicious code, viruses or other harmful material;
  • use automated means to extract substantial Website content without our permission;
  • submit false, misleading or fraudulent information;
  • misuse promotional codes or offers;
  • place orders using payment methods you are not authorised to use; or
  • use the Website in a manner that infringes the rights of Ambassador Boutique or third parties.

We reserve the right to take appropriate action where the Website is misused.

32. INTELLECTUAL PROPERTY

Unless otherwise stated, the Website and its contents, including:

  • text;
  • photographs;
  • product images;
  • graphics;
  • logos;
  • trademarks;
  • page layouts;
  • design elements;
  • articles;
  • illustrations; and
  • other original content

are owned by or licensed to Ambassador Boutique or the relevant rights holder and are protected by applicable intellectual property laws.

You may use the Website for personal and lawful purposes.

You may not reproduce, distribute, modify, publish, commercially exploit or otherwise use Website content without the prior written permission of the relevant rights holder, except where permitted by mandatory law.

33. REVIEWS, FEEDBACK AND USER CONTENT

Where the Website allows customers to submit reviews, comments, photographs or other content, you remain responsible for the content you submit.

You must not submit content that:

  • is unlawful;
  • is defamatory or abusive;
  • infringes another person’s intellectual property or privacy rights;
  • contains malicious code;
  • is misleading or fraudulent; or
  • promotes illegal activities.

Where you submit content, you grant Ambassador Boutique the non-exclusive right to use, reproduce and display that content for the purposes for which it was submitted, subject to applicable law.

We may remove content that violates applicable law or these Terms.

34. MARKETING COMMUNICATIONS

Where permitted by applicable law, Ambassador Boutique may send marketing communications to customers who have provided the required consent or where another lawful basis for direct marketing applies.

Marketing emails will normally include an unsubscribe mechanism.

You may withdraw your consent or object to direct marketing at any time.

Withdrawing consent or unsubscribing from marketing communications does not affect the lawfulness of processing carried out before withdrawal and does not affect transactional communications necessary for your orders.

35. PRIVACY AND DATA PROTECTION

Personal data processed in connection with the Website and your orders is handled in accordance with our Privacy Policy.

Depending on the circumstances, personal data may be processed for:

  • creating and managing customer accounts;
  • processing and fulfilling orders;
  • processing payments;
  • arranging delivery;
  • customer service;
  • fraud and security prevention;
  • compliance with legal obligations;
  • product safety and recalls;
  • handling returns and guarantee claims;
  • marketing where legally permitted; and
  • other purposes described in the Privacy Policy.

Our Privacy Policy explains the applicable legal bases, data retention periods, recipients, international transfers and your data protection rights.

36. PRODUCT SAFETY, RECALLS AND CUSTOMER COOPERATION

If a product is recalled or becomes subject to a safety warning, Ambassador Boutique may contact affected customers using the contact details associated with their purchase.

Customers should follow all applicable recall, safety and usage instructions.

If you become aware of an accident, serious safety issue or potentially dangerous defect relating to a product purchased from us, please notify us as soon as reasonably possible.

Where required, Ambassador Boutique will cooperate with manufacturers, suppliers and competent authorities in relation to product safety.

37. THIRD-PARTY SERVICES

Certain elements of the Website or purchase process may be provided by third parties, including:

  • payment service providers;
  • delivery and logistics providers;
  • hosting and IT service providers;
  • fraud and security providers;
  • customer service providers; and
  • analytics or advertising providers where legally permitted.

Where a third party acts independently as a controller, its own terms and privacy policy may apply.

Nothing in these Terms makes Ambassador Boutique responsible for the independent acts or omissions of third-party service providers beyond the extent required by applicable law.

38. WEBSITE AVAILABILITY

We aim to keep the Website available and functioning properly, but we do not guarantee uninterrupted or error-free access.

The Website may occasionally be unavailable because of:

  • maintenance;
  • technical problems;
  • updates;
  • cybersecurity incidents;
  • telecommunications failures;
  • failures of third-party services; or
  • circumstances beyond our reasonable control.

We will take reasonable steps to restore the Website and essential services as soon as reasonably practicable.

39. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing in these Terms excludes or limits:

  • liability for death or personal injury caused by negligence where such liability cannot legally be excluded;
  • liability for fraud or fraudulent misrepresentation;
  • liability arising from mandatory consumer protection law;
  • statutory product liability;
  • liability relating to the legal guarantee of conformity; or
  • any other liability which cannot legally be excluded or limited.

Subject to the above, Ambassador Boutique shall be liable only to the extent provided by applicable law for losses directly caused by a breach of our contractual obligations.

Consumers retain all mandatory rights available under applicable law.

40. FORCE MAJEURE

Ambassador Boutique shall not be responsible for delay or failure to perform contractual obligations to the extent that such delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include, where applicable:

  • natural disasters;
  • war;
  • terrorism;
  • civil unrest;
  • governmental measures;
  • widespread infrastructure failures;
  • serious cyber incidents;
  • strikes or industrial disputes;
  • transport disruptions;
  • epidemic or pandemic events; or
  • failures affecting essential third-party infrastructure.

Where such circumstances occur, we will take reasonable steps to minimise their impact and inform affected customers where appropriate.

This provision does not affect mandatory consumer rights, including rights relating to cancellation or refunds where legally applicable.

41. COMPLAINTS AND AMICABLE RESOLUTION

If you have a complaint concerning an order, product or service, please contact us first:

[CUSTOMER SERVICE EMAIL]

or:

LEOPOLDS SARL-S – Ambassador Boutique
1A, Rue de Fort Wallis
L-2714 Luxembourg
Grand Duchy of Luxembourg

We will make reasonable efforts to investigate and resolve complaints amicably.

Consumers may also use the consumer protection and dispute-resolution mechanisms available under applicable Luxembourg and EU law.

42. ALTERNATIVE DISPUTE RESOLUTION

Ambassador Boutique is not currently making a general commitment to participate in consumer arbitration or alternative dispute-resolution proceedings unless required by applicable law or expressly agreed for a particular dispute.

Consumers retain their statutory rights to seek assistance from competent consumer-protection bodies and to bring proceedings before a competent court.

The European Online Dispute Resolution (ODR) platform should not be referred to in current consumer communications because the platform was discontinued in 2025.

43. APPLICABLE LAW

These Terms and the contractual relationship between Ambassador Boutique and the customer are governed by Luxembourg law, subject to mandatory provisions of consumer protection law that apply to the consumer.

Where a consumer habitually resides in another country and applicable EU or national law gives that consumer mandatory protections which cannot be contractually excluded, those protections remain applicable.

Accordingly, the choice of Luxembourg law does not deprive a consumer of mandatory protections granted by the law applicable to their consumer contract.

44. JURISDICTION

For disputes involving consumers, the competent courts shall be determined in accordance with the mandatory jurisdiction rules applicable to consumer contracts.

Nothing in these Terms prevents a consumer from bringing proceedings before a court that has jurisdiction under applicable EU or national law.

For non-consumer transactions, and to the extent legally permissible, the competent courts of Luxembourg shall have jurisdiction unless the parties have validly agreed otherwise.

45. SEVERABILITY

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it lawful and enforceable, where legally possible.

The remaining provisions shall remain in full force and effect.

No invalid provision shall affect the statutory rights of consumers.

46. NO WAIVER

If Ambassador Boutique does not immediately enforce a right or provision under these Terms, this does not constitute a waiver of that right or provision.

Any waiver must be expressly made and shall apply only to the specific circumstances for which it is given.

47. CHANGES TO THESE TERMS

Ambassador Boutique may update these Terms from time to time, for example to reflect:

  • changes in our services;
  • changes in applicable law;
  • changes to our delivery or payment arrangements;
  • new Website functionality; or
  • changes to our business operations.

The version applicable to an order is the version in force at the time the relevant sales contract is concluded, unless a later change is required by law or expressly agreed with you.

The current version of these Terms will be made available on the Website.

48. ELECTRONIC COMMUNICATIONS

By using the Website and placing orders electronically, you agree that communications relating to your orders may be provided electronically, including by email.

Electronic communications may include:

  • order acknowledgements;
  • order confirmations;
  • invoices;
  • dispatch notifications;
  • delivery information;
  • return and refund communications;
  • customer service communications; and
  • legally required notices.

This does not affect any mandatory rights concerning the provision of information on a durable medium.

49. ENTIRE AGREEMENT

These Terms, together with the product information, order details and other contractual information expressly incorporated into the purchase process, constitute the contractual framework governing purchases made through the Website.

Nothing in this provision excludes mandatory statutory rights or obligations.

  • the statutory right of withdrawal;
  • delivery;
  • refunds;
  • unfair contractual terms;
